Falana Urges Nigeria, Ghana to Drag South Africa Before African Court Over Xenophobic Attacks

Human rights lawyer and Senior Advocate of Nigeria, Femi Falana, has urged the governments of Nigeria and Ghana to institute legal proceedings against South Africa before the African Court on Human and Peoples' Rights over renewed xenophobic attacks against African migrants.


Falana argued that taking complaints to the African Union alone would not provide justice for victims, insisting that only the African Court possesses the authority to order compensation and other enforceable remedies.


His position follows reports that South Africa declined Nigeria's request for compensation for citizens who reportedly lost businesses, investments and other properties after fleeing renewed attacks.


Describing Pretoria's reported refusal as "sheer insensitivity," Falana maintained that African governments must utilise available legal mechanisms to protect their citizens and hold offending states accountable.


Should Nigeria pursue legal action against South Africa over xenophobic attacks, or should diplomacy remain the preferred option?
